Terms and conditions

This is a courtesy translation. The French version is the reference text: in the event of any divergence between the two, the French version prevails. These pages are governed by Belgian law.

These terms and conditions govern the coaching and support services offered by Backes Coaching. Booking a session, signing a quote or accepting an offer implies unreserved acceptance of these terms.

2. Scope and definition of the services

Backes Coaching offers professional and personal support, in French and in English, in the following forms:

  • One-on-one coaching for private individuals, self-employed professionals and employees
  • Workplace coaching for executives, managers and leaders, funded by the employer
  • Group work (workshops and training) for teams and organisations
  • Assessments, career reviews and bundles combining one or more assessments with coaching sessions (in particular the career assessment)

Coaching is a support process oriented towards action and change. It is not therapy, nor a medical act, nor legal or financial advice. The coach makes no diagnosis and prescribes no treatment.

3. Rates

The rates applicable on the day of the order are the following, on an hourly basis:

  • Private individuals: €72.60 incl. VAT per hour (standard one-hour session)
  • Self-employed professionals, SMEs, liberal professions: €110 excl. VAT per hour (standard one-hour session)
  • Companies, institutions and group work: on quotation, drawn up after a free initial scoping conversation
  • Preview assessments: free. Career reviews and bundles (assessments and sessions): on quotation or as per the published offer.

The individual and self-employed rates are hourly rates: if a session runs beyond the standard hour by mutual agreement between coach and client, invoicing is adjusted pro rata to the time actually spent.

Rates are expressed in euros. They may be revised at any time; ongoing services are invoiced at the rate applicable when the order was placed.

4. Booking and payment terms

Sessions are booked by phone, by email, or through the online booking system. Sessions take place at the practice (Rue des buissons 15, 4000 Liège) or by video call, as agreed between the parties.

Private individuals: payment after each session, by bank transfer or in cash, within 7 days of receipt of the invoice.

Companies and institutions: payment by bank transfer within 30 days of receipt of the invoice. In the event of late payment, late-payment interest at the Belgian statutory rate (Act of 2 August 2002 on combating late payment in commercial transactions) is automatically due, together with a flat-rate compensation of €40 for recovery costs.

5. Cancellation, rescheduling and no-show

The following rules apply to any booked session or service:

  • Cancellation or rescheduling more than 48 hours in advance: free of charge; the session may be rescheduled or refunded at no cost.
  • Cancellation or rescheduling between 24 and 48 hours in advance: 50% of the session fee will be invoiced.
  • Cancellation less than 24 hours in advance, or no-show: 100% of the session fee will be invoiced.

These charges do not apply in cases of duly documented force majeure (illness with a medical certificate, accident, bereavement).

For group work in companies, the following conditions apply unless the signed quote states otherwise:

  • Cancellation more than 15 days before the service: free of charge
  • Cancellation between 7 and 15 days before: 50% of the fee
  • Cancellation less than 7 days before: 100% of the fee

6. Right of withdrawal (consumers, distance contracts)

Under Book VI of the Belgian Code of Economic Law, a consumer who enters into a distance contract for services has a withdrawal period of 14 calendar days from the conclusion of the contract, without having to give reasons or pay any penalty.

To exercise this right, the consumer notifies their decision by email to [email protected] before the period expires, by an unambiguous statement.

Waiver of the right of withdrawal: if the consumer wishes performance to begin before the end of the 14-day period, they must expressly request it in writing (email is sufficient) and acknowledge that they lose their right of withdrawal once the service has been fully performed. If performance has begun but is not complete at the time of withdrawal, the consumer must pay the amount corresponding to the service already provided, calculated pro rata.

7. Conduct of sessions and commitments of the parties

The coach undertakes to respect the ethical and professional framework of professional coaching, to deliver a quality service, to respect the client's pace and to ensure complete confidentiality of what is discussed.

The client undertakes to attend sessions at the agreed times, to take an active part in the process, to share their needs and any difficulties, and to pay for the sessions within the agreed terms.

Coaching is a collaborative process: its effectiveness depends on the client's involvement. The client remains solely responsible for their choices, decisions and actions during and after the coaching.

8. Confidentiality

Everything shared in session is strictly confidential. The coach is bound by professional secrecy and will disclose no information to third parties without the client's express agreement, save where required by law.

Where coaching is funded by a company, only the initial objective agreed at the three-way meeting and, at the end of the engagement, overall progress (objectives met or not, without detail) are shared with the sponsor. The precise content of the conversations remains strictly confidential between coach and coachee.

9. Limitation of liability

Coaching is a personal and professional development process. It is in no way a substitute for medical, psychological or psychiatric care. In the event of psychological distress or significant suffering, the coach will refer the client to an appropriate healthcare professional.

The coach has an obligation of means, not of result. No specific outcome can be guaranteed, as coaching depends on the client's commitment and choices. The coach cannot be held liable for decisions taken by the client on the basis of the sessions.

10. Intellectual property

All content, training materials, exercises, documents and methodologies used or handed over during the services remain the exclusive property of Backes Coaching. Any reproduction, distribution or use outside a strictly personal context is prohibited without prior written authorisation.

11. Personal data

Personal data provided in connection with the services (name, contact details, content of the sessions) is processed in accordance with the General Data Protection Regulation (GDPR). For more information, see the privacy policy.

12. Force majeure

Neither party can be held liable for a failure to meet its obligations in the event of force majeure (serious illness, accident, natural disaster, administrative measures, pandemic, etc.). In such a case, sessions are rescheduled by mutual agreement or, if rescheduling is impossible, refunded pro rata to the services not delivered.

13. Applicable law and jurisdiction

These terms and conditions are governed by Belgian law. In the event of a dispute, the parties will endeavour to reach an amicable solution. Failing that, the courts of the judicial district of Liège (Belgium) shall have exclusive jurisdiction.

14. Consumer mediation

Under article XVI.3 of the Code of Economic Law, where a dispute is not resolved amicably, the consumer may turn to the Consumer Mediation Service (FPS Economy):

Consumers residing in the European Union may also use the online dispute resolution (ODR) platform provided by the European Commission.

15. Changes to these terms

Backes Coaching reserves the right to amend these terms and conditions at any time. The terms applicable to a service are those in force when the order was placed. The current version is permanently available on this page.

16. Special provisions: assessments, career reviews and the platform

The following provisions supplement the terms above for services that involve the assessments and career reviews offered by Backes Coaching. Where they diverge for those specific services, they prevail.

16.1 Nature of the assessments

The assessments offered (in particular DISC, RIASEC, conflict management, drivers) are self-positioning and reflection tools. Their results are based on the participant's self-reported answers and are indicative only. They are neither a psychological, medical or clinical diagnosis, nor a recruitment or skills evaluation, and cannot be the sole basis for a decision (orientation, recruitment, promotion, selection, etc.).

16.2 Free assessments

Backes Coaching makes free preview assessments available online. Taking a free assessment entails no coaching commitment and no obligation to buy. Where the participant chooses to receive a detailed preview of their results, their contact details are only collected with their explicit consent (double opt-in), in accordance with the privacy policy.

16.3 Career reviews and bundles

Backes Coaching offers packaged services combining one or more assessments with coaching sessions, in particular the career assessment. The exact content, price and terms of each bundle are set out in the published offer or the corresponding quote, which prevails in case of divergence.

16.4 Platform and access

The assessments are taken on a dedicated, secure platform hosted within the European Union (questionnaire.backescoaching.com). Access is through a personal link. The platform is provided "as is": Backes Coaching does everything reasonable to keep it available and working properly, without guaranteeing uninterrupted, error-free access. A temporary unavailability of the platform does not engage the liability of Backes Coaching and gives no right to compensation; the service is then rescheduled by mutual agreement.

16.5 Confidentiality of results

Individual assessment results are strictly confidential between the coach and the participant. The platform never discloses an individual profile to a third party.

16.6 Right of withdrawal and digital content

Where a career review or a bundle including access to online assessments is concluded at a distance by a consumer, access to the assessments and delivery of the reports constitute the supply of digital content and services within the meaning of Book VI of the Code of Economic Law. If the consumer expressly requests that this supply begin before the 14-day withdrawal period expires and acknowledges that they lose their right of withdrawal for the part already performed, they can no longer withdraw in respect of assessments already taken and reports already delivered. The general withdrawal terms set out in article 6 continue to apply for the remainder.

This express request and acknowledgment are collected at the time of payment, through a separate checkbox that the consumer must tick before reaching the payment page; the date and the version of the wording accepted are retained as proof.

Online payment for a report or a bundle is handled by the payment provider Mollie (Mollie B.V., Netherlands, European Union).

16.7 Intellectual property

The questionnaires, models, scoring methods and generated reports remain the exclusive property of Backes Coaching or of their respective rights holders. The participant has a strictly personal right of use over their own report, excluding any reproduction, distribution or commercial exploitation.

16.8 Personal data

Data processed through the assessment platform, including results (which may constitute special-category data), is processed in accordance with the privacy policy, which sets out the purposes, the legal basis, the retention periods and the participant's rights.
